Terms of Service

Welcome to Auditend. These Terms of Service ("Terms") govern your use of the Auditend mobile application ("App") operated by Auditend, Inc. ("we," "our," or "us").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

Beta Software Notice

The Services are currently provided as pre-release beta software. By accessing or using the beta version of the Services, you acknowledge and agree to the following:

  • The beta version is provided solely for evaluation and testing purposes.
  • The Services may contain bugs, errors, security vulnerabilities, or other defects.
  • Features, functionality, user interfaces, and system requirements may change, be suspended, or be discontinued at any time without notice.
  • Information submitted through the beta version may be modified, delayed, lost, or permanently deleted.
  • Auditend does not guarantee uninterrupted availability, compatibility, reliability, or performance during the beta period.
  • You remain solely responsible for maintaining independent records of any information that may be legally or personally important.
  • Your feedback, suggestions, and recommendations regarding the beta Services may be used by Auditend without restriction or compensation.

To the maximum extent permitted by applicable law, the beta Services are provided "as is," "as available," and with all faults. Auditend disclaims all warranties, whether express, implied, statutory, or otherwise, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, or reliability.

Auditend may modify, suspend, discontinue, or terminate the beta program at any time, with or without notice, and without liability. Continued access to the Services following general release will remain subject to these Terms unless replaced by updated Terms.

1. Electronic Acceptance

By downloading, installing, accessing, or using the App, or by clicking "I Agree," "Accept," "Create Account," or any similar button, you acknowledge that you have read, understood, and agree to be legally bound by these Terms of Service and our Privacy Policy, which is incorporated by reference.

If you do not agree to these Terms, you must not access or use the App.

2. Description of Service

Auditend is a mobile application designed to help users create evidence records associated with meetings, including recovery meetings, support groups, and other scheduled events. The App provides:

  • Participant-initiated check-in evidence using location and a video selfie
  • Attendance tracking and history
  • Compliance reports for courts, sponsors, or other authorized parties
  • Meeting management to organize your scheduled meetings

3. Eligibility

You must be at least 18 years old to use the App. By using the App, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

4. Account Registration

To use the App, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Notify us immediately of any unauthorized use of your account
  • Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate your account if any information provided is inaccurate, false, or incomplete.

5. Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree NOT to:

  • Use the App to falsify attendance records or check-ins
  • Attempt to check in at locations where you are not physically present
  • Use another person's account or allow others to use your account
  • Submit false, misleading, or fraudulent information
  • Interfere with or disrupt the App's functionality or servers
  • Attempt to gain unauthorized access to any part of the App
  • Use the App for any illegal or unauthorized purpose
  • Violate any applicable laws or regulations

Accuracy of Check-ins

The App records an approximate location observation and video-selfie evidence associated with a check-in; it does not retain the current capture's precise coordinate, independently certify attendance, or compare location with a venue boundary. You acknowledge that:

  • Check-ins must be performed while physically present at the meeting location
  • Video selfies recorded during check-in must be authentic and taken at the time of check-in
  • Falsifying check-in data may result in account termination and may have legal consequences

Auditend does not guarantee that check-in records, location observations, or video verification will satisfy the evidentiary or legal requirements of any court, government agency, employer, sponsor, or other third party. Users are solely responsible for ensuring that the App meets any requirements applicable to their intended use.

6. Compliance Reports

The App allows you to generate compliance reports documenting your meeting attendance. You understand that:

  • Reports are generated based on your check-in data
  • Reports include a verification code that can be used to confirm authenticity
  • You are responsible for the accuracy of the underlying check-in data
  • We do not guarantee that any third party (court, employer, sponsor) will accept our reports
  • Reports are provided "as is" and we make no warranties about their acceptance or legal validity

Reports are disclosed only upon your separate, affirmative authorization identifying the intended recipient, report scope, and access period, except where disclosure is required by applicable law. You may optionally provide a reason for the disclosure.

7. Privacy

Your privacy is important to us. Our handling of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. Consumer health data is also governed by the separate Consumer Health Data Policy. Accepting these Terms is not consent to collect consumer health data: the App requests a separate, affirmative consent before core attendance-evidence collection. You may later withdraw that consent in Settings, which stops new check-ins unless you consent again.

8. Intellectual Property

The App and its original content, features, and functionality are owned by Auditend and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.

You may not:

  • Copy, modify, or distribute the App
  • Reverse engineer, decompile, or disassemble the App
  • Remove any copyright or proprietary notices
  • Transfer the App to another person or "mirror" the App on any other server

9. Third-Party Services

The App may contain links to or integrate with third-party services, including:

  • Supabase — Backend infrastructure, authentication, and storage
  • Geoapify and Google Places — Maps and meeting-address lookup
  • Postmark — Transactional email
  • Sentry — Crash and performance diagnostics
  • Google ML Kit — On-device selfie image processing (runs on the device; no data transmitted)
  • Fly.io — Hosting for Auditend's report-rendering infrastructure
  • Apple, RevenueCat, and Stripe — Purchase and subscription processing when applicable

We are not responsible for the content, privacy policies, or practices of any third-party services. Your use of third-party services is at your own risk and subject to their respective terms and conditions.

10. Disclaimers

The App is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied.

We do not warrant that:

  • The App will be uninterrupted, secure, or error-free
  • The results obtained from using the App will be accurate or reliable
  • Any errors in the App will be corrected
  • The App will meet your specific requirements

Location Services

The App relies on location services provided by your device. Location readings may be inaccurate. Auditend records an approximate-area observation as one part of participant-initiated evidence; it does not certify proximity to a venue or independently determine attendance.

Not Legal Advice

The App is a tool for tracking meeting attendance. We do not provide legal advice, and the App should not be considered a substitute for legal counsel. If you have questions about court requirements or legal obligations, consult with a qualified attorney.

11. Limitation of Liability

To the maximum extent permitted by law, Auditend shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of profits, data, or goodwill
  • Service interruption or computer damage
  • Any damages arising from your use or inability to use the App
  • Any damages arising from unauthorized access to your account
  • Any damages related to third-party acceptance or rejection of compliance reports

Our total liability for any claims arising from your use of the App shall not exceed the amount you paid us (if any) in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless Auditend, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Any false or fraudulent check-in data you submit

13. Account Termination

By You

You may request account deletion through App settings or by contacting support@auditend.com. Eligible personal data is removed as described in our Privacy Policy and Consumer Health Data Policy. A minimum signed integrity record may be retained when needed to preserve an already-issued report or comply with a documented legal or record-preservation obligation.

By Us

We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Falsification of check-in data
  • Extended periods of inactivity
  • Request by law enforcement or government agency

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by:

  • Posting the updated Terms in the App
  • Updating the "Last Updated" date
  • Sending you an email notification for significant changes

Your continued use of the App after changes become effective constitutes acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the App.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of laws principles.

You agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the App shall be subject to the exclusive jurisdiction and venue of the state and federal courts located in San Diego County, California. You waive any objection to the exercise of jurisdiction by such courts or to venue in those courts.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Auditend regarding your use of the App and supersede any prior agreements.
